Agreement to these Terms
These Terms govern access to and use of the Functional Tutoring Learning Platform. By creating an account, accepting an invitation, or using the platform, you agree to these Terms and acknowledge the Privacy Policy. If you are using the platform for an organization or on behalf of a student, you confirm that you have authority to do so.
Eligibility and student accounts
Self-service registration is available only to people who are at least 13 years old. A person under 13 must not create a self-service account. A parent or legal guardian should contact Functional Tutoring before use by a child under 13. Users must provide accurate account information and keep it current.
Accounts and security
You are responsible for safeguarding account credentials and activity under your account. Do not share credentials or attempt to use another person’s account. Notify us promptly if you believe an account has been compromised. We may suspend access when reasonably necessary to investigate abuse, protect users, or secure the platform.
Educational service
The platform provides practice, diagnostics, explanations, score estimates, recommendations, and tutoring-support tools. These are educational aids, not guarantees of a particular test score, admission result, academic outcome, or improvement. Students and tutors remain responsible for reviewing recommendations and making appropriate educational decisions.
Automated and AI-assisted features
Some content, summaries, recommendations, or drafts may be generated or assisted by automated systems. Automated output can be incomplete or incorrect. Authorized tutors and administrators should review generated material before relying on it, and students should report suspected errors using the available reporting tools.
Acceptable use
You may not:
- Break laws, infringe rights, harass others, or submit harmful or deceptive content.
- Attempt to bypass account restrictions, rate limits, security controls, diagnostic limits, or access permissions.
- Probe, scrape, reverse engineer, disrupt, overload, or introduce malicious code into the platform.
- Copy, publish, sell, or distribute platform question banks, diagnostics, explanations, or proprietary materials except as expressly authorized.
- Use automated generation features to create unlawful, infringing, or unsafe material.
User materials
You retain ownership of materials you are authorized to upload. You grant Functional Tutoring permission to host, process, reproduce, and display those materials as reasonably necessary to provide and secure the service. You must have the right to upload submitted material and should not upload unnecessary sensitive information.
Platform materials
The platform, software, design, question banks, workflows, and Functional Tutoring materials are owned by Functional Tutoring or its licensors and are protected by applicable laws. Subject to these Terms, users receive a limited, personal, non-transferable right to use the platform for its intended educational purpose.
Availability, changes, and paid features
We may improve, modify, suspend, or discontinue features. Features identified as “coming soon,” including paid account functionality, are not currently available for purchase and do not create a promise of release. If paid services are introduced, pricing, billing, cancellation, and refund terms will be provided before a purchase.
Termination
You may stop using the platform at any time and may request account closure. We may restrict or terminate access for material violations, security risks, nonpayment of future paid services, unlawful conduct, or when continued access would expose users or the service to harm. Provisions that by their nature should survive termination will remain effective.
Disclaimers and limitation
The platform is provided on an “as available” basis to the extent permitted by law. We do not warrant uninterrupted operation or error-free educational content. To the extent permitted by law, Functional Tutoring will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the platform. Rights that cannot legally be waived remain unaffected.
Test-provider independence
SAT is a trademark of the College Board, and ACT is a trademark of ACT, Inc. Functional Tutoring is not affiliated with or endorsed by these organizations unless expressly stated otherwise.
Changes and contact
We may update these Terms as the service changes. Material revisions will receive a new effective date and may require renewed acceptance. Questions can be sent to tyler@functionaltutoring.com.
